Responsibility for the appointment lies with the President and the Speaker, but the Colonial Secretary, Henry Parkes, disagreed with the nomination and the appointment remains unfilled.

The writer for Freeman's argues that the Herald's editor is publishing a 'paid libeller and reviler of every object held dear by Catholics, not only in this colony but all over the world'. The author of the 'paid libels' is the Herald's foreign correspondent, the US-based Anna Blackwell, writing under the pseudonym 'Stella'.
